General terms and conditions of sale

Article 1: Preamble

​These terms and conditions of sale are entered into, on the one hand, by MSA-LUX, S.à r.l.-S, 67, rue Adolphe Fischer, L-1520 Luxembourg, under the number B214863 hereinafter referred to as "the seller" and, on the other hand, by any natural or legal person, hereinafter referred to as "the buyer", wishing to make a purchase via the website www.imunobran.lu  (hereinafter referred to as "www.imunobran.lu).

Article 2: Purpose

The present conditions of sale aim to define the contractual relations between the seller and the buyer as well as the conditions applicable to any purchase made through the seller's website, whether the buyer is a professional or a consumer. The acquisition of a good or service through this site implies unreserved acceptance by the buyer of these conditions of sale. These conditions of sale shall prevail over any other general or specific conditions not expressly approved by the seller. The seller reserves the right to modify its conditions of sale at any time. In this case, the applicable conditions will be those in force at the date of the order by the buyer.

Article 3: Characteristics of the goods and services offered

The products and services offered are those listed on the seller's website. Each product is accompanied by a description drawn up by the supplier. The photographs are as accurate as possible but cannot ensure a perfect similarity with the product offered, particularly with regard to colours. These products and services are offered within the limits of available stocks. If, despite its efforts, all or part of the articles are unavailable, the seller shall inform the buyer by e-mail as soon as possible and offer him the possibility of choosing between waiting or cancelling the order of the unavailable articles without charge. The available articles will be delivered normally.

Article 4: Prices

The prices of the products and services displayed on the site are indicated in euros including all taxes (VAT and other applicable taxes). The seller reserves the right to modify its prices at any time. Nevertheless, the prices applicable to the order are those in force at the time of confirmation of the order. The prices indicated do not include the costs of order processing, transport, delivery and payment, provided that they take place in the geographical areas indicated below.

Article 5: Geographical areas

The online sale of products and services presented on the Seller's website is reserved for buyers who reside or work in the Grand Duchy of Luxembourg, France and the European Union for deliveries requested in these geographical areas. The customer has a recommendation to buy our products from Luxembourg and France.

Article 6: Orders

The buyer, who wishes to buy a product or a service must

​- fill in the identification form on which he/she will indicate all the requested details;

- fill in the online order form giving all the references of the products or services chosen;

- validate the order after having checked it; - make the payment in accordance with the conditions provided;

​- confirm the order and payment.

Confirmation of the order implies acceptance of these terms and conditions of sale, recognition of having perfect knowledge of them and renunciation of the right to invoke one's own conditions of purchase or other conditions. All the data provided and the recorded confirmation will be considered as proof of the transaction. Confirmation shall be deemed to be consent to the operations carried out. The seller will communicate by e-mail confirmation of the registered order.

Article 7: Right of renunciation

In accordance with the law, the consumer has the right to notify the seller that he/she renounces his/her purchase, without penalty and without giving any reason, within 14 working days from the day following the delivery of the product or the conclusion of the service contract. This right of renunciation does not apply to the professional buyer. Within this period, the consumer must notify his intention to renounce by e-mail and return, at his expense and risk, the product delivered to the administrative headquarters of MSA-LUX, S.à r.l.-S for the Grand Duchy of Luxembourg. The products must be returned in their original packaging, undamaged, accompanied by all accessories, the user manual and the original invoice/delivery note. Products returned in this way must not have been unpacked, unsealed or used in any way. Incomplete, damaged or soiled goods returned by the customer will not be accepted. Within 30 days after acceptance of the return of the goods, the seller undertakes to reimburse any payment, with the exception of the processing, shipping and payment costs. Unless otherwise agreed, the consumer may not exercise the right of renunciation for contracts

1. the supply of services whose performance has begun with the consumer's consent before the end of the period of renunciation;

2. the supply of products made to the consumer's specifications or clearly personalised or which, because of their nature, cannot be returned or are likely to deteriorate or expire rapidly.

Article 8: Payment methods

Le paiement s'effectue par PayPal ou par carte de crédit, ou en espèces à notre bureau.  Les articles commandés restent la propriété exclusive du vendeur jusqu'au paiement intégral de la commande par l'acheteur.

Article 9: Deliveries

Deliveries are made to the address indicated on the order form, which can only be within the agreed geographical area. The goods are transported at the seller's risk until the goods are delivered to the delivery address specified by the buyer. From that moment onwards, the buyer bears the sole risk. Delivery times are given as an indication only; if they exceed thirty days from the date of the order, the If the delivery time exceeds thirty days from the date of the order, the sales contract may be terminated and the buyer reimbursed.

Article 10: Guarantee

With regard to consumers, the seller guarantees that the products it sells and the services it offers comply with the law in force at the time of purchase. In case of non-conformity of a sold product found within 2 months of delivery of the goods, the consumer must notify the seller as soon as possible in a precise manner by registered letter or e-mail. This guarantee only covers defects of conformity existing at the time of delivery of the goods. Defects or damage due to improper use, such as water damage, oxidation, dropping or impact, negligence and wear and tear, are not covered by the guarantee. The invoice or delivery note serves as a guarantee document and must be kept by the consumer and produced in original. If the product is used for non-private purposes, the limited warranty conditions of the manufacturer/supplier apply.

Article 11: Liability

The seller, in the online sales process, is only bound by an obligation of means; it cannot be held liable for any damage resulting from the use of the Internet network such as loss of data, intrusion, virus, breakdown of service, or other involuntary problems. The data on the site is given in good faith. The links to the websites of manufacturers and/or partners are provided for information purposes only. The seller cannot be held responsible for information from these sites.

Article 12: Intellectual property

All elements of the seller's site are and remain the exclusive intellectual property of the seller. No one is authorised to reproduce, exploit, rebroadcast or use in any way whatsoever, even partially, the elements of the site, whether they be software, visual or sound. Any simple link or hypertext link is strictly forbidden without the express prior written consent of the seller.

Article 13: Personal data

All personal data necessary for the processing of an order are stored by the seller or its employees and may be its employees and may be passed on to companies with which the seller - or its suppliers - collaborates with, when such communication is necessary for the processing of the order.
